TERMS OF SERVICE

Welcome to Beauty One.

These Terms of Service (“Terms”) govern your use of Beautyone.ca, online booking services, and beauty and wellness services provided by Beauty One Spa & Weightloss Centre Inc., also known as Beauty One and Beauty One Spa (“Beauty One,” “we,” “us,” or “our”).

By accessing our website, booking an appointment, making a payment, or receiving a service from Beauty One, you agree to these Terms.

Nothing in these Terms limits any rights or remedies that cannot legally be limited under applicable consumer protection or other laws.

1. Our Services

Beauty One provides beauty and wellness services, including eyelash extension services and other services that may be offered from time to time.

Services, availability, pricing, appointment lengths and descriptions may change. The services displayed on our website may not always be available at every time or with every service provider.

Beauty One may refuse, discontinue or modify a service where reasonably necessary for safety, suitability, staff availability or other legitimate business reasons.

2. Booking Appointments

Appointments may be booked through Beautyone.ca, our booking platform, by telephone, in person, or through another booking method made available by Beauty One.

You are responsible for providing accurate contact and booking information.

An appointment is not guaranteed until it has been accepted or confirmed through our booking system.

Beauty One may require a deposit, advance payment or valid payment method to reserve an appointment.

3. Cancellations, Rescheduling & No-Shows

Our cancellation, rescheduling, deposit and no-show rules displayed during booking form part of these Terms.

By booking an appointment, you agree to the policy shown to you at the time of booking.

Where disclosed before booking, Beauty One may charge or retain an applicable deposit, cancellation fee or no-show fee.

Repeated cancellations, no-shows or payment disputes may result in Beauty One declining future bookings.

Nothing in this section affects rights available to you under applicable law.

4. Late Arrivals

Please arrive on time for your appointment.

If you arrive late, Beauty One may need to shorten, modify or reschedule your service so that subsequent appointments are not affected.

If there is not enough time to safely or properly perform the booked service, the appointment may be treated according to our cancellation or no-show policy.

5. Prices & Payment

All prices shown on Beautyone.ca are in Canadian dollars unless otherwise stated and are subject to applicable taxes.

Prices may change at any time before a booking is completed.

If the requested service changes during your consultation or appointment, any material change in price will be communicated before the additional or different service is performed.

By providing a payment method, you represent that you are authorized to use it and authorize Beauty One and its payment providers to process amounts associated with your booking, including any properly disclosed deposits or applicable cancellation/no-show fees.

Beauty One may correct obvious pricing, technical or typographical errors.

6. Service Results

Beauty and wellness services are personal in nature, and individual results vary.

Photographs, examples, descriptions and social-media content are provided as examples only and are not guarantees that your result will be identical.

For eyelash extensions in particular, appearance, retention and longevity can vary based on natural lashes, skin type, lifestyle, aftercare, shedding cycles, sensitivities and other individual factors.

Beauty One does not guarantee a specific duration, appearance or result unless expressly stated in writing.

7. Client Responsibilities & Safety

You are responsible for providing Beauty One with accurate information that may reasonably affect the safety or suitability of your service.

This may include relevant allergies, sensitivities, previous reactions, medications, eye conditions, injuries, pregnancy or other circumstances relevant to the requested service.

Beauty One may recommend that a service be modified, postponed or declined where we reasonably believe proceeding may be unsafe or unsuitable.

You are also responsible for following any preparation and aftercare instructions provided by Beauty One.

8. Lash Extension Risks

Eyelash extension services involve products and adhesives used near the eyes.

Possible reactions or side effects may include irritation, redness, watering, sensitivity, swelling, allergic reaction, discomfort, premature lash shedding or damage to natural lashes.

These reactions may occur even where a client has previously received eyelash extensions without a problem.

A patch test or previous successful service does not guarantee that a future reaction will not occur.

If you experience a significant or unexpected reaction, discontinue use of any relevant products and seek appropriate medical attention where necessary.

9. Service Consent

Certain services may require you to complete an intake form, consultation, acknowledgement, waiver or informed consent form before treatment.

Any service-specific consent or waiver forms supplement these Terms.

Beauty One may decline to perform a service if required information or consent is not provided.

10. Concerns About a Service

If you have a concern about a service, please contact Beauty One as soon as reasonably possible so we have an opportunity to review it.

Except where otherwise required by law, completed beauty services are generally non-refundable.

Depending on the circumstances, Beauty One may choose to offer an adjustment, correction, credit or other resolution. Any such remedy is determined based on the individual situation and does not create an obligation to provide the same remedy in another case.

11. Refills & Existing Lash Work

Where applicable, eligibility for a lash refill may depend on the condition and amount of extensions remaining when you arrive.

If there are insufficient extensions remaining or additional work is required, Beauty One may recommend that the appointment be treated as a new set or different service.

Any material price change will be communicated before proceeding.

Beauty One may also decline to work over or refill extensions originally applied by another provider where doing so could compromise the quality or safety of the service.

12. Minors

You must have the legal capacity to enter into a binding agreement to make a booking on your own behalf.

Beauty One may require the consent or attendance of a parent or legal guardian before providing services to a minor and may decline particular services to minors.

13. Gift Cards, Promotions & Credits

Gift cards, promotional offers, Beauty One credits, rewards and similar programs may be subject to additional terms disclosed when they are issued.

Promotional offers have no cash value unless expressly stated otherwise and cannot be combined unless permitted by the applicable promotion.

Gift cards will be administered in accordance with applicable Ontario law, including applicable restrictions concerning expiry dates and fees.

14. Online Booking & Third-Party Services

Beauty One may use third-party providers for website hosting, appointment scheduling, communications, payment processing, analytics and other functionality.

Your use of those services may also be subject to the provider's applicable terms and privacy practices.

Beauty One is not responsible for temporary outages or failures caused solely by third-party systems that are outside our reasonable control, subject to applicable law.

15. Email & Text Communications

When you provide an email address or telephone number in connection with an appointment, Beauty One may use it to send service-related communications such as confirmations, reminders, booking updates and receipts.

Marketing messages will only be sent where permitted by applicable law and applicable consent requirements.

You may unsubscribe from marketing communications using the method provided in those communications.

16. Website Information

We make reasonable efforts to keep information on Beautyone.ca accurate and current.

However, website information may occasionally contain errors or become outdated.

Beauty One may correct or update website content, service descriptions, availability and pricing at any time.

17. Acceptable Use

You may not use Beautyone.ca to:

• engage in fraudulent, unlawful, abusive or threatening conduct;
• interfere with the operation or security of the website;
• introduce malicious software or harmful code;
• attempt unauthorized access to any system or account;
• scrape, reproduce or commercially exploit website content without permission;
• impersonate another individual or provide deliberately false information; or
• infringe Beauty One's or another person's intellectual-property rights.

Beauty One may restrict access to the website or booking system where we reasonably believe these Terms have been violated.

18. Intellectual Property

Beautyone.ca and its original content, including the Beauty One name, logos, branding, photographs, graphics, layouts, text and other materials, are owned by or licensed to Beauty One and are protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial purposes.

No Beauty One content may be copied, reproduced, distributed, modified or commercially used without prior authorization except where permitted by law.

19. Client-Submitted Content

If you voluntarily submit a review, testimonial, photograph or other content to Beauty One for publication or tag Beauty One in content with the intention that we share it, you represent that you have the right to provide that content.

Where you have authorized us to use it, you grant Beauty One a non-exclusive, royalty-free right to reproduce, display and share that content for Beauty One's promotional purposes.

Any identifiable client photography taken by Beauty One for marketing purposes will be handled in accordance with the consent obtained from the client and applicable privacy requirements.

20. Privacy

Beauty One collects and uses personal information in accordance with our Privacy Policy and applicable privacy laws.

Please review our Privacy Policy for information about how personal information is collected, used, stored and disclosed.

21. Website Availability

Beauty One does not guarantee that Beautyone.ca or its online booking services will always operate without interruption or error.

We may modify, maintain, suspend or discontinue website functionality when reasonably necessary.

22. Disclaimer

To the fullest extent permitted by law, Beautyone.ca and its website content are provided on an “as available” basis.

Beauty One does not guarantee uninterrupted website access, error-free operation or that all information available through the website will always be complete or current.

Nothing in this section excludes warranties, conditions or consumer rights that cannot lawfully be excluded.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Beauty One will not be liable for indirect, incidental, special, exemplary or consequential damages arising solely from your use of Beautyone.ca or our services.

Where liability may legally be limited, Beauty One's aggregate liability arising from a particular paid service will not exceed the amount actually paid to Beauty One for the service giving rise to the claim.

This limitation does not apply where liability cannot legally be excluded or limited, and nothing in these Terms is intended to exclude liability arising from fraud, willful misconduct or any other liability that applicable law requires Beauty One to bear.

24. Indemnification

To the fullest extent permitted by law, you agree to indemnify Beauty One and its officers, employees and representatives against third-party claims, losses or reasonable expenses arising directly from:

• your unlawful or fraudulent use of Beautyone.ca;
• content you submit that infringes another person's rights;
• your intentional violation of these Terms; or
• your misuse of Beauty One's systems or intellectual property.

This section does not require you to indemnify Beauty One for Beauty One's own negligence or unlawful conduct.

25. Refusal of Service

Beauty One reserves the right to refuse or discontinue service where reasonably necessary, including because of abusive, threatening, discriminatory, unsafe or inappropriate behaviour; suspected fraud; non-payment; repeated policy violations; or circumstances that make the requested service unsafe or inappropriate.

Beauty One will exercise this right in accordance with applicable law, including applicable human-rights obligations.

26. Force Majeure

Beauty One will not be responsible for delays or inability to perform obligations caused by events reasonably outside our control, including severe weather, power or telecommunications outages, emergencies, government restrictions, labour disruptions or similar events.

Where an appointment is affected, we will make reasonable efforts to reschedule or otherwise address the booking.

27. Changes to These Terms

Beauty One may update these Terms from time to time.

The current version will be posted on Beautyone.ca with the date it was last updated.

Changes apply prospectively from the effective date and will not remove rights that have already accrued under applicable law.

28. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.

Subject to any rights available to consumers under applicable law, disputes relating to these Terms or Beauty One's services will be determined by courts of competent jurisdiction in Ontario.

29. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or severed only to the extent necessary, and the remaining Terms will continue in effect.

30. Entire Agreement

These Terms, together with our Privacy Policy, applicable booking policies and any service-specific consent forms, constitute the agreement governing your use of Beautyone.ca and Beauty One's services.

Where a mandatory law provides greater rights or protections, that law will prevail.
